Portrait Photography Terms and Conditions

 

  1. Brendan Lyon Photography is a trading name of Event Portraits Limited. This contract is agreed between Event Portraits Limited and the Person or Persons (known as the Buyer) purchasing the services and the Person and/or Persons who are subjects in the photographs.
  2. References to “the photographer” mean the photographer appointed by Event Portraits Limited to execute the terms of this contract. This also includes any reference to his appointed agents or assistants if present.
  3. The Buyer agrees that all portrait photographic and related services provided by Event Portraits Limited are subject to these terms and conditions.
  4. A shoot fee is required to confirm a photographic shoot. This fee must be paid in advance of the shoot in order to confirm a booking.
  5. Shoot fees are not refundable outside exceptional circumstances.
  6. When ordering photographs, a 50% deposit must be paid at time of ordering. The balance is payable on delivery.
  7. Digital items must be paid for in full at time of ordering.
  8. Event Portraits Limited take no responsibility for issues relating to the printing of digital items by the Buyer or the Buyer’s agents.
  9. Digital items may vary in size due to cropping.
  10. Event Portraits Limited normally guarantee print size from digital images up to A4 size. The Buyer understands and accepts that cropping may reduce this size.
  11. harges for photographs must be paid for at time of ordering.
  12. Post production is performed by Event Portraits Limited on all purchased images. Small blemishes are normally removed and any reasonable corrections are made at no extra charge. Colour correction, conversion to black and white and contrast corrections are all included. Event Portraits Limited strive to produce images of the highest quality at all times and will make any reasonable effort to create a quality image. However, Event Portraits Limited reserve the right to recommend third party pixel manipulation at the sole discretion of Event Portraits Limited.
  13. Where intensive pixel manipulation is requested by the Buyer, Event Portraits Limited will obtain a quotation for this work by a third party and will only proceed with the agreement of the Buyer.
  14. In the unlikely event that intensive manipulation is required, the Buyer understands and accepts that this labour intensive process is available at an additional fee as it is possible to spend several hours or even days manipulating (“photoshopping”) a single image.
  15. Event Portraits Limited will not take photographs with cameras or other equipment belonging to Guests.
  16. In the unlikely event of any complaints, the Buyer should raise the issue in writing within 21 days from the date of receipt of images. In the unlikely event of an unresolved complaint the Buyer may request the Irish Professional Photographers Association to mediate but only on the basis that its decision shall be final and binding upon both parties.
  17. The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control as in force majeure or Act of God or the event of a total photographic failure. Under these circumstances, neither party shall be liable for indirect or consequential loss.
  18. Copyright of all images taken remains with Event Portraits Limited at all times. Commercial use of any images supplied by Event Portraits Limited is prohibited.
  19. Event Portraits Ltd reserves the right to use any of the images captured in studio, web site, portfolio, literature, display areas, exhibitions, competitions, advertising or any other manner for Event Portraits Limited commercial and promotional purposes.
